1. Introduction
Welcome to Yaatrees! These Terms and Conditions ("Terms") govern your use of the
Yaatrees mobile application ("App"). The App is provided by Yaatrees ("we", "us", or "our").
Please read these Terms carefully before using our App. By accessing or using our App, you
agree to be bound by these Terms. If you do not agree with any part of these Terms, you
must not use our App.
2. Privacy Policy
Our Privacy Policy explains how we collect, use, and share your personal information. By
using our App, you agree to the collection, use, and sharing of your information as described
in our Privacy Policy.
3. Eligibility
You must be at least 18 years old to use our App. By using our App, you represent and
warrant that you are at least 18 years old and have the legal capacity to enter into these
Terms.
4. User Account
To use certain features of our App, you may need to create a user account ("Account"). You
agree to provide accurate and complete information when creating your Account and to keep
your Account information up to date. You are responsible for maintaining the confidentiality
of your Account password and for all activities that occur under your Account.
5. User Content
Our App allows you to post content, such as photos, comments, and other materials ("User
Content"). You retain all rights in your User Content. However, by posting User Content on
our App, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and
sublicensable licence to use, reproduce, modify, adapt, publish, translate, distribute, and
display your User Content in any media.
You represent and warrant that you own or have the necessary rights to post your User
Content on our App and that your User Content does not violate any laws, regulations, or
third-party rights.
6. Prohibited Activities
You agree not to use our App for any prohibited activities, including but not limited to:
- Posting or sharing content that is illegal, harmful, threatening, abusive, harassing,
defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or
otherwise objectionable;
- Impersonating any person or entity or falsely stating or otherwise misrepresenting your
affiliation with a person or entity;
- Engaging in any activities that could interfere with the proper working of our App or that
could damage, disable, overburden, or impair our App or any server, computer, or database
connected to our App;
- Using our App for any commercial purposes without our prior written consent;
- Violating any applicable laws or regulations.
- Engaging in activities that incite violence, promote illegal drugs, or violate any laws or
regulations. Violation of these activities may not only result in termination of your account but
could also lead to civil or criminal penalties.
7. Intellectual Property
All intellectual property rights in our App, including but not limited to text, graphics, logos,
icons, images, audio clips, video clips, and software, are owned by us or our licensors and
are protected by copyright, trademark, and other intellectual property laws. You may not use,
copy, reproduce, modify, distribute, transmit, display, perform, publish, or create derivative
works from any part of our App without our prior written consent.
8. Third-Party Links
Our App may contain links to third-party websites or services that are not owned or
controlled by us. We have no control over, and assume no responsibility for, the content,
privacy policies, or practices of any third-party websites or services. You acknowledge and
agree that we are not responsible or liable for any loss or damage caused or alleged to be
caused by or in connection with the use of or reliance on any such content, goods, or
services available on or through any such third-party websites or services.
9. Limitation of Liability
To the maximum extent permitted by law, we and our officers, directors, employees, agents,
and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or
exemplary damages, including but not limited to damages for loss of profits, goodwill, use,
data, or other intangible losses, arising out of or in connection with your use of our App, even
if we have been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold us and our officers, directors, employees, agents, and
licensors harmless from and against any and all claims, damages, liabilities, costs, and
expenses, including but not limited to legal fees, arising out of or in connection with your use
of our App, your violation of these Terms, or your violation of any third-party rights.
11. Termination
We may terminate your access to our App, without cause or notice, which may result in the
forfeiture and destruction of all information associated with your Account. All provisions of
these Terms that by their nature should survive termination shall survive termination,
including but not limited to ownership provisions, warranty disclaimers, indemnity, and
limitations of liability. Activities that may lead to termination include, but are not limited to,
prohibited activities, infringing on any intellectual property rights, inciting violence, promoting
illegal drugs, or any other violations of these Terms. All decisions regarding termination will
be at the sole discretion of Yaatrees.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of any changes by posting
the new Terms on our App. Your continued use of our App after we post the new Terms
constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you
must stop using our App.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your
Country], without regard to its conflict of law provisions.
14. Identity Verification
In order to ensure the safety and authenticity of our users, we require all users to verify their
identity. This involves uploading a photograph of yourself along with a clearly visible
government-issued identification document (e.g., passport, driver's licence) that includes
your face. This is a crucial step to prevent the creation of fake profiles and to protect our
community from fraudulent activities.
If you do not complete the identity verification process, your access to the app will be limited
to read-only mode. This means you will be able to view profiles, posts, and bios of other
users, but you will not be able to post content, comment, or participate in any other
interactive features of the app.
By using our app, you agree to provide accurate and current identification for identity
verification purposes. You also acknowledge and agree that your failure to provide accurate
identification or complete the identity verification process may result in limited access to the
app or termination of your account.
15. User Interactions
When interacting with other users on our App, you agree to act responsibly and exercise
caution, discretion, and common sense. All interactions, including any resulting relationships
or meetings in person, are at your own risk. We are not responsible for the actions of any
user on or off the App.
16. Subscription and Billing
We offer subscription services within our App. When you choose to subscribe to our
services:
Subscription Terms: The specific terms of your subscription, including the services provided,
the subscription period, and the cost, will be provided to you at the time of subscription.
Billing: By subscribing to our services, you agree to pay the subscription fees as set out at
the time of subscription. All payments will be processed through the Play Store (for Android
users) or the App Store (for iOS users). The standard billing policies of the respective store
will apply.
Renewals: Unless otherwise stated, your subscription will automatically renew at the end of
each subscription period. You can manage or cancel your subscription through the settings
in the Play Store or App Store.
Refunds: Refund requests should be made in accordance with the refund policies of the Play
Store or App Store. We do not control or manage refunds directly.
Changes to Subscription Services: We reserve the right to modify our subscription services,
including changing the price, suspending, or discontinuing any service. We will provide you
with reasonable notice of any significant changes.
By subscribing to our services, you acknowledge and agree to these subscription and billing
terms. Regular Play Store or App Store subscription and billing policies may apply.
17. Dispute Resolution
Any disputes arising out of or in connection with these Terms or your use of our App will first
be addressed by notifying the other party and attempting to resolve the dispute internally
within 45 days. If the dispute is not resolved within this period, it will be settled by arbitration.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Yaatrees and its officers, directors,
employees, agents, and licensors shall not be liable for any direct, indirect, incidental,
special, consequential, or exemplary damages, including but not limited to damages for loss
of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with
your use of our app, even if we have been advised of the possibility of such damages.
While we strive to protect your personal information and privacy, we cannot guarantee the
security of any information you disclose online, and you do so at your own risk. We disclaim
liability for any unauthorised access to, disclosure, or damage to your information, or for any
unauthorised access to or use of our secure servers and/or any and all personal information
and/or financial information stored therein.
19. No Guarantee of Accuracy
Yaatrees is not responsible for any information or content that you access from our App.
While we strive to provide accurate and up-to-date information, we cannot guarantee the
accuracy, completeness, or timeliness of any content or information on our App.
20. Precautionary Measures
Yaatrees is designed to help solo travellers connect and share experiences. While we
require users to verify their identity using government-issued IDs, this measure is intended to
enhance the authenticity of profiles and reduce the risk of fraudulent activities. However:
No Complete Guarantee: Even with government ID verification, we cannot guarantee the
complete authenticity or intentions of every user. The verification process is a tool to
increase user safety, but it is not foolproof.
No Background Checks: We do not conduct comprehensive background checks on users,
nor do we guarantee the complete safety or authenticity of user profiles.
User Discretion: We do not endorse any user, content, or interaction on our platform. Users
should exercise caution, use their best judgement when interacting with others, and take
necessary precautions when deciding to meet in person.
By using our platform, you acknowledge the inherent risks of online interactions and agree to
take necessary precautions to ensure your safety.
